General Booking Terms and Conditions

 

These terms and conditions for travel booking through www.airmiles.ca  (the "Website") constitute a legal agreement and are entered into by and between you and [AIR MILES Loyalty Inc.] ("Company," "we," "us," or "our"). All bookings for travel products (the "Travel Products") made through the Website are subject to: (1) these terms and conditions, and (2) the terms and conditions of the supplier of the Travel Product (a "Travel Supplier"), including the terms and conditions of an airline for flight products, a hotel or other property for hotel stays or a car rental company for car rentals.

 

It is a condition of booking any Travel Product through the Website that you accept these Travel Supplier terms and conditions (the "Travel Supplier Terms"), which will be made available to you before you make a booking.

 

If you violate the applicable Travel Supplier Terms, your booking may be cancelled and you may be denied access to the relevant Travel Product, which may be done without a refund. You may also be responsible to reimburse us or the Travel Supplier for any costs we or they incur as a result of such violation.

 

Payment for Travel Products may be made by Credit Card or by redeeming AIR MILES® Dream Miles or a combination of the two. When booking with AIR MILES® Dream Miles, they will be deducted from your Dream Account within three business days after booking. Minimum thresholds may apply when using AIR MILES® Dream Miles. Minimum threshold is 50% for Blue Collectors, 25% for Gold Collectors.  There is no minimum for Onyx Collectors.  The lead passenger must be logged into their AIR MILES account (Collector Number and PIN or email address and password) at the time of booking. Only one AIR MILES® Collector Number can be used per booking. A valid credit card will be required at the time of booking to pay for all applicable surcharges, taxes, and fees. Our Program only accepts Canadian Issued Credit Cards.

 

Unless otherwise stated on this Website, all prices are expressed in Canadian dollars, provided that any charges to be paid locally to a Travel Supplier may be required to be paid in local currency.

 

Following your booking of a Travel Product, you will receive a confirmation e-mail ("Booking Confirmation") which will include the essential elements of your booking, such as the description of the Travel Products booked and the price. We will send your Booking Confirmation and any relevant travel documents to the email address you provide when you book. If you do not receive your Booking Confirmation within 24 hours of making your booking, please contact us.

If you purchase a flight through our website, we are acting as an agent for the Travel Provider and your contract for the flight is between you and the relevant Travel Provider. The price and availability of your flight is only guaranteed once your purchase of the Travel Product is completed, and your tickets are issued. Air travel may be subject to 72-hour advance booking, minimum and maximum stay, and the availability from participating airlines.

 

Airlines control their schedules, and they may change or cancel your flight for a variety of reasons. We will provide you with any information about a change or cancellation to your flight itinerary that the airline provides to us.

 

Airlines also control seating and we do not guarantee the availability of specific seats, even when pre-booked.
If you book a return flight and do not use the outbound flight, the airline may cancel the return flight without refund.

 

You are responsible for confirming your flight departure time before departure. Some airlines will have schedule changes and your flight times may differ from what is stated on your Itinerary. We recommend that you reconfirm your outbound and return flights at least 24 hours prior to each journey directly with the carrier. We are not responsible for schedule changes.

 

Not all airlines have the same baggage allowance policy. You are responsible for checking the airline's baggage policy in advance of your departure to verify the terms, including weight and item limits.

 

Check-In times and procedures vary by airline and by airport.  Please check with your airline for details on check-in times and policies by visiting their website or mobile app.

If you purchase accommodation through our Website, we are acting as agent for the Travel Provider and your contract for the hotel room is between you and the relevant Travel Provider.

 

Hotel bookings may be subject to advance booking restrictions, as well as availability (where availability may be withdrawn without notice).

 

You agree that your payment method will be charged by us for the total booking amount at the time of booking, which includes the room rate displayed through our Website, plus taxes and service fees or, where applicable, taxes on the room rate and/or services provided by us. On making your booking request, you authorize us to facilitate the booking on your behalf, including making payment arrangements with Travel Providers.

 

Resort or amenity Fees may not be included with your purchase at the time of booking (unless otherwise specified) and will need to be paid directly to the hotel upon check-in. Please see the hotel description for any additional fees and inclusions.

If you purchase a car rental through our Website, we are acting as agent for the Travel Provider and your contract for your car rental is between you and the relevant Travel Provider.

 

All drivers must be 25 years of age or older to rent a car through the Website.

 

Extra charges may be payable by you locally to the Travel Provider. These charges may include fuel, snow tires, additional driver charges, young driver surcharges, child seats and delivery and collection fees, etc. We are not responsible for paying such extra charges. It is your responsibility to determine in advance what additional charges may apply to your booking.

 

When you collect your rental car, the driver must present their valid credit card. You must check with the Travel Supplier which credit cards they accept. Debit cards are not accepted. The Travel Supplier may submit an authorization request to your credit card issuer during the rental period by way of a deposit. Additional drivers must meet the same requirements as the primary driver. Additional Driver fees may apply for all additional drivers.

 

When you collect your rental car, the driver must present their valid driver's license for the category of vehicle rented. International rentals may have different driving license requirements. Please check what exact documentation is required by the Travel Supplier. For example, if the driver's license is not in the Roman alphabet, an international driving license is required. Extra documentation, such as a passport or up to two forms of proof of name and address, may also be required.

 

Typically, you will not be permitted to take your rental car outside of the rental country, or on ferries, and additional restrictions may apply.

 

If you do not comply with the above rules or fail to comply with any applicable Travel Supplier Terms, the Travel Supplier may not make the vehicle available to you and you may, subject to the applicable Travel Supplier Terms, be required to pay an amount up to the full price of your car rental.

 

An insurance excess amount may be applicable in the event of theft of, or damage to, the rental car and payable by you directly to the Travel Supplier. This will vary depending on the Travel Supplier and rental country. Purchase of optional extra insurance coverage by you locally can remove or reduce the applicable excess. We are not responsible for any excess payable or the provision of extra insurance coverage. You are strongly encouraged to purchase sufficient insurance coverage to limit your liability in the event of an accident or other claim.

 

Fuel is not usually included in the rental price. In some countries, some Travel Suppliers may charge you for refueling when the vehicle is returned. Unless agreed otherwise, you must return the rental car to the same branch of the Travel Supplier from which it was collected. In addition, in Quebec and other jurisdictions, it may be mandatory that rented vehicles be equipped with winter tires during certain months. Additional fees may be payable in connection with winter tires (whether or not mandated by law).

Some Travel Suppliers offering features, activities, experiences and transfers may require you to sign their liability waiver prior to participating in the Travel Product they offer.

 

Features, activities, experiences and transfers are not usually transferable nor eligible for refunds or changes unless the Travel Supplier cancels such Travel Product.

 

Each Travel Product may be offered separately or as part of a bundle and is subject to the applicable Travel Supplier Terms.

 

These details are not exhaustive and do not replace the relevant Travel Supplier Terms, which will be provided to you before you make a booking.

If you purchase a cruise through our Website, we are acting as agent for the Travel Provider and your contract for your cruise is between you and the relevant Travel Provider.

 

Cruise lines may from time-to-time change itineraries, skip ports of call or even substitute vessels for safety, weather, or other reasons. These events are beyond our control and are not eligible for compensation or refunds.

 

Several cruise line companies have age restrictions on the main traveller listed on a cabin booking (in most cases ranging from 18 years of age to 21 years of age). Please review the specific Travel Supplier Terms for your selected cruise line on details regarding this matter.

 

Prices are based on double occupancy. Prices may vary if a customer is booking a single, triple, quadruple or quintuple occupancy per cabin/stateroom, altering the pricing format set out by the tour operator or cruise line. When a cruise price is confirmed at the time of your booking, the actual price reflecting occupancy changes will then appear.

 

Cruise packages include, the prices of the cabin reservation and other included cruise vacation related activities, meals, etc. as identified by the cruise line. Extra payments such as drink purchases, onboard gratuities, excursion costs, and/or other are unrelated to the booking price of a Cruise Vacation Package and are not the responsibility of the Company.

 

All products are subject to availability. All informational content, such as cruise ship information (both in written and image form) and destination information on this Website is provided only as a guideline and may not be an exact representation. We are aware that you need accurate information and as a result will make every effort possible to ensure that the content within this Website is up to date. However, due to constant changes and occasional circumstances beyond our control, some of the cruise ship and destination information within this Website may not be entirely accurate. We make every effort to ensure that images on this Website are as close a representation as possible, but cannot be held responsible for changes or inaccuracies.

 

Cruise lines must adhere to their departure times from each port; please allow sufficient time to get to the port for check-in both on the day the cruise is set to sail along with every port of call. It is recommended to travel the day before your cruise with an overnight in the port of embarkation to ensure adequate time to check-in. When booking your return flight, ensure to select a flight late enough in the day to allow you to disembark and check-in at the airport with adequate time. Any missed flights are not the responsibility of the Company.

We provide the opportunity for you to book more than one Travel Product together at the same time through our Website (for example, a hotel booking and a flight booking) but each Travel Product is subject to its own Travel Supplier Terms and these terms (such a combined booking is a “Travel Package”).

 

If you purchase a Travel Package through our Website, we are acting as agent for the applicable Travel Provider(s) and your contract is between you and the relevant Travel Provider(s).

The maximum number of passengers allowed on one booking is 8. If your travelling party is 9 passengers or more, you will need to divide your group across two or more bookings.

Cruise

$50 per booking

Cancellations, changes and refunds will be subject to the Travel Supplier Terms for the applicable Travel Product. Should you book a non-refundable product, changes are not permitted, and no refund will be given, regardless of the circumstances. Please review cancellations policies for each Travel Product prior to booking as it will vary by product.

 

Booking fees where applicable are non-refundable. An additional AIR MILES change or cancellation fee will apply should a Booking change be required (where permitted by the applicable Travel Supplier).

 

Refunds, where permitted, will be refunded to the original form of payment by way of a credit card refund and/or returned AIR MILES Dream Miles depending on original form of payment.

 

Where permitted, changes to reservations that require full cancellation and rebooking at the then-current rate at the time of such rebooking, which rebooking may require further payment and/or the redemption of additional AIR MILES Dream Miles in the event of a change in fees, supplier, location, date(s) or any other aspect of the Travel Product. You will also be responsible for any additional taxes, fees and/or surcharges in connection with such rebooking that may be applicable. Any changes to your booking are subject to availability.

 

Changes or cancellation of Travel Packages may be limited by the most restrictive change or cancellation policy (up to and including no option to change/cancel or refund a booking) and/or may incur multiple Travel Supplier change fees.

If you have a complaint while on a trip you must contact the Travel Supplier or AIR MILES immediately to provide a reasonable opportunity to rectify the issue promptly during your trip. If the matter cannot be resolved on the spot, you must notify us in writing to CollectorRelationsTeam@airmiles.ca within 14 days of the completion of your trip. We cannot consider post vacation submissions if you did not provide your Travel Supplier and/or us with a reasonable opportunity to assist you during your trip. We reserve the right to give any compensation due in the form of AIR MILES Dream Miles or future travel discounts.

Flight:

An unaccompanied minor is a child (8 to 11 years) travelling alone. Reservations for unaccompanied minors are not available through the Website.

 

Infants can be added during the booking and there are applicable fees/taxes for transborder and international flights. An infant must be accompanied by a parent or by a person at least 16 years or older. An infant is a child who has not reached their second birthday as of the date of commencement of travel. Age requirements do vary, so please confirm with your Travel Supplier before booking.

 

The following can only be added directly by the airline and applicable fees may apply: adding an infant to an existing booking, an infant turning 2 while at destination, and an infant requiring a seat.

 

Accommodation:

Some hotels may have a minimum age requirement to be able to occupy a room which may be higher than 18 years. Please check with your hotel Travel Supplier Terms for minimum age requirements.

 

Car Rentals:

The minimum age for renting a car through the Website is 25 years.

To ensure that airlines make the best possible preparations for you, we encourage you to select the type of assistance you’ll require, preferably at the time you book your flight.

 

The following special needs requests may be added during the booking process:

·       Wheelchair needed to get to the departure gate (but can walk to seat)

·       Wheelchair needed to get to departure gate and to airline seat

·       Passenger is visually impaired

·       Passenger is hearing impaired

 

If the special request was not provided or wasn't added during the booking, please contact the airline directly.

Before you make your reservation, you must first contact the airline to check if your request can be accommodated on the desired flight. If confirmed, book your flight on the Website. Once your flight is booked, contact the airline to provide the details of your special request.

Accommodation:

When you check into your hotel, your reservation or confirmation number and a valid credit card will be required to be provided directly to the Travel Supplier. The Travel Supplier may also require government issued photo ID for one or all the registered guests in your room.

 

Car Rentals:

We recommend that you inquire with the Consular Affairs Bureau for Canadians Abroad or review online the Essential Information for Canadian Travellers Guide at travel.gc.ca to satisfy personal requirements.

 

For some countries, international health certificates and vaccinations are required. In some cases, failure to present required vaccination documentation (e.g., Yellow Fever vaccination) may result in you being denied entry into a country.

 

We recommend you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel.

 

Under applicable law, entry to another country may be refused even if the required information and travel documents are complete. It is your responsibility to ensure you have obtained a valid visa and have satisfied all other requirements for entry prior to departure for your trip.

 

Living standards and practices at the destination and the standards and conditions there with respect to the provision of utilities, services and accommodation may differ from those found in Canada

Unless otherwise stated, prices displayed on our Website do not include travel insurance. You are strongly encouraged to take out insurance that covers the consequences of certain cases of cancellation and certain risks (including illness or accident). While some credit cards offer travel insurance to cardholders, such coverage may be limited or inadequate. You are responsible for ensuring that any insurance policy taken out adequately covers your requirements.

 

For an additional charge, we offer travel insurance for purchase through the Website. Our travel insurance plans are provided by Manulife, and accordingly when you purchase travel insurance through our Website, your contract for insurance is between you and Manulife.
